Seriously though, I think leaving the scene might get the driver a harsher penalty, but I think a strong argument could be made for self defense. If you believe that your life might be in danger, you get a lot more latitude on "proportionate force".
The man who beat the guy up: Arrestable for Felony Aggravated Assault, Destruction of Property, Jwalking among other things.
The man who ran the guy over: Arrestable for Hit and Run, Assault with A Deadly Weapon, and numerous traffic violations.
So in this case the guy who was beat up would probably spend more time in jail than the guy who beat him up.
Lucky no one got shot.

Add the word "Aggravated" to that. It's a much lesser crime when you nearly kill someone that just beat the living snot out of you than when you do it just for fun or because he cut you off in the intersection.

Not only that, but the beaten guy was obviously retreating from the now finished brawl and the other guy came at him a second time! Since he was in a car but with a window opened, the thing prescribed by self-defense law would be to flee the scene. That is what he did (if he had gone in reverse he would have smashed the assailant's car, which could be construed as retaliation). The situation is similar to crashing in a car running a red light: not your fault.

Only if you can prove intent to harm, without reasonable doubt. In the video it looks like the driver turns so as to run his assailant over, be he could defend himself by saying he tried to shake him off the hood, however clumsily. I'm pretty sure a jury would side with the victim here. There's also the matter of the Castle Doctrine, which stipulates you can use deadly force to defend a place legally occupied, and where in some jurisdiction "place" can also include a car.
Plus, that other guy was (apparently) a total asshole. No sympathy.
wtf are you supposed to do when someone beats you up and leaves you lying in the street THEN comes and breaks your windshield.
what if the guy had poured gasoline on the hood of the car and went to light it? (as i often see in Reno 911) it's not far off from that situation though. He's gotten violent enough to start just beating up the guys car.

To all who thinks this was "self defense": try it and when you show up as a felon at my facility, I'll laugh at you as I tell you when and where you can and can't go what what you can and can't do.
What exactly is the guy in the car supposed to do, Marine? He's just had the fucking shit beaten out of him... he's trying to escape and the attacker JUMPS ON HIS CAR. The attacker's car is behind him, there's only one place to go. At that point I'd say all bets are off, red shirt guy is asking to be run over.
Have you ever been randomly assaulted in public? I have, and during my escape, anybody jumping on my car would have been in serious danger, ESPECIALLY if it was the frigging guy attacking me.
Anyhow, keep on keeping america safe by power tripping at the brig or whatever bullshit you're talking about.
