ABC Reporter Arrested: Taking Pictures of Senators, Donors

ABC news was working on a story about the funding of the events surrounding the DNC. Reporter Asa Eslocker was taking video and pictures of senators and lobbyists outside of the Brown Palace Hotel. He was on the sidewalk of a public street. He was first informed (falsely perhaps?) that the sidewalk was owned by the hotel and that he had to vacate it. "The sheriff's officer is seen telling Eslocker the sidewalk is owned by the hotel. Later he is seen pushing Eslocker off the sidewalk into oncoming traffic, forcing him to the other side of the street." Soon, a Denver police officer arrived, arrested him, and hauled him off in handcuffs... Police on the scene refused (legally) to tell ABC lawyers the cause of the arrest. Later they informed them that the charges were tresspassing, Interferance, and Refusal to obey a lawful order.

Actually, the cops made the arrest because the hotel asked them to--they claimed the film crew was obstructing the entrance. Also important to note is that the arrest doesn't happen until two hours later (gotta love how the edited clip makes it look like it was instant). Asa was allowed to leave peacefully and set up cameras across the street after the first complaint but when he and the film crew decided to camp out in front of the hotel the second time the cops placed him under arrest.

I found the more complete story of what happened here: http://www.cpj.org/news/2008/americas/usa28aug08na.html

Arrested for tresspassing?

Cannot be arrested where there are no signs, no fences and no notice of borders.

Those are the rules of the castle doctrine, if any one from the public can walk on it with out going over a barricade of some sort it is public domain.

1. Must Have signs (no loitering)
2. Must have a fence.
3. Must have an entrance.
4. must have an exit.
